These Terms & Conditions govern the use of https://jasdehydrator.com (“Website”) and all quotations, orders, and supply of machinery by Jas Enterprise.
By accessing this Website or placing an order, you agree to these Terms.

2. Nature of Business
Jas Enterprise is a manufacturer and exporter of food processing and dehydration machinery.
All website content is for informational purposes only.
A binding contract is formed only upon written quotation acceptance and receipt of agreed advance payment.
3. Intellectual Property
All designs, drawings, technical specifications, catalogues, images, videos, and content remain the intellectual property of Jas Enterprise.
No reproduction or duplication is permitted without written consent.
4. Quotations & Pricing
- Quotations are valid for the period mentioned therein.
- Prices are subject to change due to raw material costs, currency fluctuation, and logistics variation.
- Taxes, freight, insurance, installation, and duties are extra unless specified.
- Orders are confirmed only after advance payment as agreed.
5. Payment Terms & Default Protection
- Payment terms shall be as per quotation (e.g., 50% advance, balance before dispatch).
- Production begins only after receipt of advance payment.
- If payment is delayed:
- Production may be suspended.
- Dispatch may be withheld.
- Storage charges may apply.
- Interest at 18% per annum may be charged on overdue amounts.
If payment default continues beyond 30 days:
- Jas Enterprise reserves the right to cancel the order.
- Advance payment shall be non-refundable.
- Legal recovery proceedings may be initiated.
Ownership of goods remains with Jas Enterprise until full payment is received.
6. Production & Delivery
Delivery timelines are estimates only.
Delays caused by:
- Material shortages
- Government restrictions
- Port congestion
- Export documentation issues
- Force majeure events
shall not make Jas Enterprise liable for penalties or damages.
Risk transfers to buyer as per agreed Incoterms (EXW / FOB / CIF etc.).
7. Installation & Commissioning Responsibility
Unless specifically included in the quotation:
- Installation is the buyer’s responsibility.
- Buyer must ensure proper:
- Electrical supply
- Earthing
- Space and ventilation
- Raw material quality
- Skilled operators
If installation support is agreed:
- Travel, lodging, and service charges are payable by buyer.
- Buyer must provide local assistance and required utilities.
Improper installation voids warranty.
8. Technical Acceptance Clause
Before dispatch:
- Machines are tested at our factory.
- Video proof or inspection may be provided on demand.
Upon delivery:
- Buyer must inspect the machine within 7 days.
- Any visible damage must be reported immediately.
- If no written complaint is received within 7 days, the machine shall be deemed technically accepted.
Performance depends on:
- Raw material quality
- Operator skill
- Environmental conditions
Minor variations shall not constitute a defect.
9. Warranty
Warranty (if provided) is limited to manufacturing defects only.
Warranty does NOT cover:
- Electrical fluctuations
- Improper use
- Wear & tear parts
- Unauthorized modifications
- Negligent handling
Liability under warranty is limited to repair or replacement of defective parts only.
10. Liquidated Damages Protection
Under no circumstances shall Jas Enterprise be liable for:
- Production loss
- Business interruption
- Loss of profits
- Indirect or consequential damages
- Delay penalties
Total liability shall not exceed the invoice value of the supplied machine.
No liquidated damages shall apply unless expressly agreed in writing.
11. Force Majeure
Jas Enterprise shall not be liable for delay or failure in performance due to events beyond reasonable control, including:
- Natural disasters
- War or civil unrest
- Government regulations
- Export/import restrictions
- Strikes or labor shortages
- Pandemic or epidemic
- Supply chain disruption
- Power or transportation failure
Delivery timelines shall be extended accordingly.
12. Cancellation Policy
- Advance payments are non-refundable.
- Custom-built machinery cannot be cancelled once production begins.
- Cancellation charges may apply based on production stage.
13. Limitation of Liability
To the maximum extent permitted by law:
Jas Enterprise shall not be responsible for:
- Installation errors by buyer
- Improper electrical supply
- Third-party component failure
- Business loss or downtime
Maximum liability is strictly limited to product value.
14. Arbitration (Instead of Court Litigation)
In case of any dispute arising out of or relating to:
- Orders
- Payments
- Delivery
- Performance
- Warranty
The matter shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India).
- Arbitration shall take place in Ahmedabad, Gujarat, India.
- Proceedings shall be conducted in English/Hindi/Gujarati.
- The decision of the arbitrator shall be final and binding.
Courts in Ahmedabad shall have jurisdiction only for enforcement of arbitration awards.
15. Governing Law
These Terms shall be governed by the laws of India.
16. International Buyers
Buyers outside India are responsible for:
- Compliance with local import regulations
- Electrical compatibility
- Customs clearance
- Local certifications
